Plan and Disclosure Statement
On May 15, 2020, Imerys Talc America, Inc. and 2 affiliated debtors (collectively, the "Debtors") filed their Plan of Reorganization and the Disclosure Statement related thereto. On January 27, 2021, the Bankruptcy Court entered an order approving the Disclosure Statement. At this time, the Confirmation Hearing, which had previously been scheduled for November 15, 2021, has been cancelled. This website will be updated with additional information as it becomes available.
If you have a Talc Personal Injury Claim, you or your attorney on your behalf, as permitted by the Voting Procedures, have the right to vote on the Plan. The deadline by which ballots must be received by the Debtors’ solicitation agent, Prime Clerk LLC (now known as Kroll Restructuring Administration), was March 25, 2021 at 4:00 p.m. ET.
Detailed instructions regarding how to vote on the Plan are contained in the Voting Procedures Order and on the Ballots distributed to holders of Claims that are entitled to vote on the Plan. Please click here to review the Voting Procedures Order.
Please note that all Ballots should be returned (i) by online transmission through the E-Ballot platform (facsimiles or other electronic submissions including e-mail, will NOT be accepted), which may be accessed by clicking the "Submit E-Ballot" link on the left hand side of this page, (ii) by mail, using the envelope included in the Solicitation Package, or (iii) by mail, hand delivery, or overnight courier to the Imerys Ballot Processing Center, c/o Prime Clerk LLC (now known as Kroll Restructuring Administration), One Grand Central Place, 60 East 42nd Street, Suite 1440, New York, NY 10165.
Attorneys for holders of Direct Talc Personal Injury Claims will receive the Certified Plan Solicitation Directive from Prime Clerk LLC (now known as Kroll Restructuring Administration). The Certified Plan Solicitation Directive must be returned to Prime Clerk LLC (now known as Kroll Restructuring Administration) no later than February 17, 2021. Please refer to the Certified Plan Solicitation Directive for directions on how to return your client’s vote to Prime Clerk LLC (now known as Kroll Restructuring Administration) prior to the deadline to vote on the Plan (March 25, 2021 at 4:00 p.m. Prevailing Eastern Time).
If you or your counsel have not received a Ballot and you are a holder of a Talc Personal Injury Claim, you may request a Ballot by emailing firstname.lastname@example.org. Holders of Talc Personal Injury Claims requesting a Ballot will receive their voting information via email within two (2) business days of the request.

On February 13, 2019, the Debtors each filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware. The cases are pending before the Honorable Laurie Selber Silverstein, and are jointly administered under Case No. 19-10289.
